1. Definitions
In these Terms and Conditions, the following words have the meanings set out below:
- "Company", "we", "us", "our" refers to Sinar Capital, operating from Persiaran Lagoon 9, 47500 Subang Jaya, Selangor, Malaysia.
- "Participant", "you", "your" refers to any individual who enrols in or attends a Sinar Capital course or programme.
- "Course" or "Programme" refers to any educational offering delivered by Sinar Capital, including Reading Your Insurance Policies, Right-Sizing Coverage in Mid-Life, and the Comprehensive Household Protection Programme.
- "Content" refers to all materials, checklists, worksheets, webinar recordings, and other resources provided to participants as part of a Course.
- "Agreement" refers to these Terms and Conditions together with any enrolment confirmation issued to you.
2. Acceptance of Terms
By submitting an enquiry or enrolment form, or by attending any session of a Course, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
You must be at least 18 years of age to enrol. Our courses are designed for adults and are not suitable for participants under 18.
If you are enrolling on behalf of another person, you confirm that you have their authority to do so and that they accept these terms.
3. Service Description
Sinar Capital provides financial education courses focused on insurance literacy for adults aged 40 and above in Malaysia. All courses are educational in nature. Nothing in any course session, material, checklist, or adviser consultation constitutes personalised financial advice regulated under the Capital Markets and Services Act 2007 or the Financial Services Act 2013.
The adviser consultations included in our programmes are educational sessions aimed at helping you understand your existing coverage. They are not regulated financial planning services and do not result in any advice report, recommendation, or product placement.
4. Enrolment and Participation
Enrolment is confirmed when you receive a written confirmation from us following receipt of your course fee. Places are allocated on a first-paid basis. We reserve the right to decline enrolment at our discretion.
You are responsible for ensuring you have a suitable device and internet connection to participate in webinar sessions. We will provide the session link and any access credentials in advance of each session.
We reserve the right to remove a participant from a programme if their conduct is disruptive to other participants or staff, without refund.
5. Participant Responsibilities
As a participant, you agree to:
- Treat instructors, advisers, and fellow participants with courtesy and respect
- Not record, reproduce, or redistribute any webinar session without prior written consent from Sinar Capital
- Not share course materials, checklists, or worksheets with individuals who have not enrolled
- Provide accurate information during enrolment and in any consultation session
- Not use course content for commercial purposes or on-selling without written agreement from us
6. Intellectual Property
All course materials, checklists, worksheets, reading guides, and webinar content are the intellectual property of Sinar Capital. You are granted a limited, non-exclusive, non-transferable licence to use these materials for your personal household planning purposes only.
You may not copy, adapt, translate, publish, or distribute any course content without our written permission. This restriction applies to digital files, printed materials, and any notes derived substantially from our content.
7. Payment and Refunds
Course fees are quoted and payable in Malaysian Ringgit (RM). Payment is required to confirm enrolment. We accept bank transfer and common Malaysian online payment methods. Details are provided on the invoice issued to you.
Refund Policy
- If you contact us before the second session of your course, we will defer your enrolment to the next available intake at no additional charge, or issue a credit note for the course fee.
- Requests received after the second session has commenced will be considered on a case-by-case basis.
- If we cancel a course intake, enrolled participants will receive a full refund or transfer to an alternative intake, at their preference.
8. Disclaimers
Our courses are provided "as is" for educational purposes. We do not warrant that any particular outcome will result from attending our courses, including any specific financial, coverage, or planning outcome.
Nothing in our course content, adviser consultations, or written materials should be understood as a recommendation to purchase, cancel, or modify any insurance or takaful product. Decisions regarding insurance coverage remain solely your own.
9. Limitation of Liability
To the extent permitted by Malaysian law, Sinar Capital's liability to you in connection with any course or service is limited to the course fee paid by you for the relevant programme.
We are not liable for any indirect, consequential, or economic loss arising from your participation in our courses or from any decision you make in connection with your insurance coverage, regardless of how that decision was informed.
10. Dispute Resolution and Governing Law
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from or in connection with these terms shall first be referred for informal resolution by contacting us at [email protected].
If informal resolution is not achieved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia, with the courts of Selangor having primary jurisdiction.
11. General Provisions
These Terms and Conditions constitute the entire agreement between you and Sinar Capital in relation to your enrolment and participation. If any provision is found to be unenforceable, the remaining provisions continue in full effect.
Our failure to enforce any provision of these terms at any time does not constitute a waiver of that provision or any other. You may not assign your enrolment to another person without our prior written consent.
12. Changes to These Terms
We may update these Terms and Conditions from time to time. Updated terms will be published on this page with a revised "Last Updated" date. For enrolled participants, material changes will be communicated by email. Continued participation in a course after receiving notice of changes constitutes acceptance of the updated terms.
